As promised by City Manager John Russo, the City has, starting in September, made the agendas for the City Council meetings available ten days in advance of the meeting. So the agenda for the first meeting for September is already up and has been since last week which is a marked change. John Knox White blogs a bit about it here and this is good news since it comes on the heels of the City posting the meeting agenda for the Special City Council meeting before the August break at the very last minute per state law for noticing special meetings.
One very interesting agenda item comes in the Council Referrals section from Councilmember Doug deHaan, which is:
There continues to be a complete lack of confidentiality inside of city hall regarding identification of applicants for posted positions. This occurred during the selection process of the City Manager, as well as the recent selection of the City Attorney. It is standard practice in the public and private sectors not to reveal applicant names for any position for which they wish to apply. Confidentiality must be upheld throughout all stages of the process, and particularly during the interview portion, thus not to jeopardize present employment of the applicant. However, the selection criteria and timeline used in this process must be transparent and open to the public.
Recently, Mayor Gilmore adamantly expressed concerns of the continued lack of confidentiality. Similar complaints of this nature have also been expressed by a councilmember, as well as candidates themselves. Lack of integrity on behalf of the City of Alameda representatives has caused undue personal consequences to applicants and has compromised the validity and merit of the selection process.
These actions are not in the best interest of the citizens of the City of Alameda. These council selections have been conducted in closed session. It is therefore requested that a complete review be conducted to determine the root of this ongoing problem and that immediate and necessary action be taken and procedures adopted.
For those that don’t read David Howard’s Action Alameda blog, there was a “tip” that was not verified by any secondary source that Danny Wan, former Oakland City Councilmember and now City Attorney for Morgan Hill, was in the running for the City Attorney position. I believe that was the only name “leaked” to the public.
In fact, during the public comment for the July meeting one of the speakers representing Alameda Citizens Task Force made a reference to not wanting anyone else from Oakland to come to Alameda about two and a half minutes into the audio track which appeared to be a reference to the Danny Wan rumors.
As an aside, it should be noted that this comment which attempted to speculate as to who one of the finalists was for the City Attorney position was completely erroneous. Evidently this commenter believed that she had spotted Benjamin Reyes (Alameda resident and City Attorney for both Pinole and Union City, he works at a private law firm which those two cities contract with) at City Hall West on that Saturday morning. It turns out that Benjamin Reyes was in Hawaii at that very moment. Let me just point out the obvious that not all Asian people look the same, I know it can be hard to tell us all apart, but I promise, there are fairly distinct features for all of the Asian races.
Anyway, I think it was very wise of Doug deHaan to get in front of this issue, because when — not if — it becomes a bigger issue the pool of people that had access to the names of candidates is pretty limited. It really is only the City Council itself and a handful of staff people. Amongst the City Council, there are obviously individuals that would never ever ever in a million years ever leak anything to David Howard. And, let’s face it, most of the applicants probably aren’t leaking their own names either given that they probably don’t want their bosses to know that they are actively looking for another job. Although honestly, I don’t know what the City is going to be able to do about the leaks.
And speaking of City Attorney news, apparently former City Attorney Teresa (Terri) Highsmith has taken on the interim duties for yet another city under her Colantuono and Levin contract. Now she is working for the City of Sierra Madre in addition to her duties in Barstow.
When did the Auditor and Treasure and Start leaking we have unsustainable Salary and Pension and benefit commitments to Our City employees ?
How come staff made recommendations for huge salary pension and benefit increases during worst financial situation our country has ever faced while millions being laid off and business shutting doors ?

As long as City Hall hires human beings, there will be leaks. The is something about a secret that makes some adults act like 3rd graders. Don’t be so sure about where David Howard gets his info. It could be that one or more of the board members has confided in someone who has told someone else (after being sworn to secrecy, no doubt) and that person told…you get the idea. What I would worry about if I worked at City Hall, is everyone getting so worked up about this that they make a scapegoat out of some secretary. Of course confidentiality, is desirable but is it possible? Maybe not here in Mayberry. Oh that Aunt Bea!

Last I looked, Blogging Bayport did not have an “in” basket @ City Hall, but Action Alameda does, b/c BBA is merely a blog; Action is a news medium, right up there w/the Sun. This also means anyone @ City Hall can anonymously put something in Action’s basket. I would not call such info a leak. Why do you continue to complain about Howard? Since City Attorneys working for more than one city seems to be quite common, I fail to see how disclosing applicant names imperils anyone’s “current employment”. On a conflict of interest basis, I would think the citizens have a right to know if their city attorney works for a competing city (as in this LBNL contest!) And as a citizen of a California city, I would like to know if the management of my city, whose salary I’m tax-paying, is about to fly the coop. Example:A few weeks after I sat down w/David Brandt to discuss the APD threat to my vehicles, and was assured he would “take care of it”, he surfaced in Redmond, WA. Obviously, he didn’t! And his being out of state makes him untouchable.

Actually, I thought Teresa Highsmith might be tooling it around Barstow, since her name was on the warrants! I was talking abt the language, Lauren. Most Filipinos I know are Pinoy, & there aren’t any in your video! Are you able to distinguish between Asians & Pacific Islanders? I did not see the face of the man I thought might be Reyes, just his suit & the top of his head (come to think of it this guy did have less hair than Ben). I didn’t think he would become CA, but might be advisory, being Bonta’s old campaign treasurer & all.

“The City Attorney stated the City has an email policy which states that City email has no privacy expectation; City email is to be used for City purposes; the email policy has
been fairly long standing; every employee and official signs a receipt of the policy; that she sent a written request to John Knox White requesting the return of the confidential
Closed Session packet comprised of 698,000 bites of information that clearly shows that Councilmember Tam forwarded information to Mr. Knox White; that she has not
received any response.Mayor Johnson inquired whether Mr. Knox White would be complying with the request.
Mr. Knox White responded that he received the City Attorney’s request last week; stated that his attorney would be sending a response tomorrow; that he would not comply with

I’m Filipino, but I don’t speak Tagalog, and consider myself Asian Pacific islander, although I was born and raised in Alameda. But back to the posting about deHaan’s council referral. Of all the councilmembers, isn’t he the closest to David Howard? Or to rephrase Adam, isn’t David Howard considered deHaan’s “favorite?”

I believe David Howard has a very close relationship with former Interim City Manager, Ann Marie Gallant and with Mr. deHaan and many of Mr. deHaan’s supporters. That is not to say that there is anything inappropriate went on, or is going on. Information from closed session has been “leaked” recently a couple of times, and I recall at least one council session where the City Attorney had to stop Mr. deHaan from speaking in open session as he was discussing a closed session matter.
Vigi, when you went to address the Council group at the Point prior to their interviewing the City Attorney candidates, how long did you stay to observe who was coming and going from the interviews? Just long enough to incorrectly tell others that you saw Ben Reyes and so he must have been a candidate, or longer so you could see and report who the others were as well?
My point here is that too many people want to “be in the know” so that they can be the first to tell others “hot news”. This is different than the transparency we need, where we are all aware of what is going on (be advised of the subject matter of civic meetings and have access to them and supporting documents) and have an opportunity to comment. Rumors and gossip are not particularly helpful, and often have the effect of making things much more toxic than they need to be.

20:Unlike what you read in BBA & SD&R [which, as usual, is distorted & embellished], the Vigilante was slouched in a chair next to an open window (no A/C) on the 2nd floor above the outside front entrance to City Hall West catching up on some RAB reading, in the very same room the Navy will be having its public meeting this Wed nite, as a matter of fact. Vigi is an individual, not “members”& , being disabled, is incapable of “running around” anything. As stated above (Kate never finishes reading), I never said Reyes was “it”, but inferred that his FIRM, Meyers-Nave, might be supplying Alameda’s next CA, as it has for other Calif communities.
Vigi did not see any other people other than Chris, apparently Lena Tam’s enforcer. Chris kept coming upstairs to check on me as I sat reading & MINDING MY OWN BUSINESS, occasionally looking out the window & hearing Rob Bonta using his cell phone. The still air, w/no street noise causes outside sound to carry quite clearly . It was otherwise quiet, perfect for a lazy afternoon of reading. I had no idea the City Council would ruin it by being there ALL DAY!!!

“Vigi” if you were there and you sat or spoke at the public comment period it was explained to one of the speakers during an abnormal session of back and forth that the City was working on hiring an individual to work full time as City Attorney and that this process was not to contract with a law firm to outsource the City Attorney’s office.
So, just so we’re on the same page you (1) misidentified Benjamin Reyes based on a suit and a back of the head glimpse even though someone else has independently confirmed that he was on vacation, (2) inferred that you erroneous id meant that the City would be hiring Meyes Nave as the City Attorney, (3) even though the point of the process was to hire an individual and not outsource the City Attorney role as clarified during the public comment period.

Danny Wan would be a huge get for the City Attorney position. He has strong experience and has led an office before. Plus he adds some needed diversity to City Hall. My City Hall friends tell me that that office really needs some purging and is still pretty supportive of Highsmith’s actions the past couple of years. I hope that Russo can put in a good word for him and he comes in and makes changes (though he probably does not need it).

Oakland—This week, dwindling support for gang injunctions in Oakland faced a major blow as Meyers Nave, the costly private lawfirm used by the City Attorney’s office to prosecute the injunctions, was caught swindling $1.2 million from the City of Bell. Also this week, it seems to be all but official that City Attorney John Russo will retreat from the gang injunction fight to the City Manager position in Alameda.
On April 4 the Daily Journal revealed that Meyers Nave, who has already faced fire in the Oakland gang injunction case for illegally unsealing youth records, as well as exceeding the costs of its original agreement, was paid 1.2 million in legal fees by the scandal-ridden city of Bell while their partner served as the interim City Attorney. “This is unconscionable,” says Michael Siegel, one of a volunteer legal team working to defend those named on the Fruitvale injunction “Meyers Nave has proven that they are, in essence, a mercenary outfit. They will pursue any lawsuit so long as they are paid. Here in Oakland they have taken positions—allegedly in the ‘public interest’—that contradict Oakland’s long history as a sanctuary for multicultural communities and civil and human rights. The result is that we are facing virtual martial law over Oakland’s most historic Latino neighborhood.” Meyers Nave has already been paid ten of thousands of dollars in tax payer funds to push the Oakland injunctions through the courts.
Meanwhile, City Attorney John Russo, the unpopular and increasingly isolated leader of the charge for gang injunctions, is expected to withdraw this week in the face of widespread opposition to take the City Manager position in Alameda. “Clearly, Russo is cutting his losses before he ruins what’s left of his political career,” says Sagnicthe Salazar, Fruitvale resident, and anti-injunction activist. “Any new City Attorney will be defined by their choice of whether or not to pursue Russo’s expensive, unpopular, and ineffective strategy of implementing gang injunctions in Oakland.”
The City Council has 60 days to fill the City Attorney’s seat. Final arguments in the Fruitvale injunction hearings are set for May 4, 2011
Alameda has already paid millions to outside law firms [check "Bills 4 Ratification" in the CCConsentCalendars of the past year B4U challenge that statement!] It doesn’t matter how Lauren Do twists what I say, when the payments are a matter of record. The “process” she refers to is to hire a City Attorney. Period. The suits lined up to march into that building all day were gonna show up no matter what was said in the public comment period–unless those calls Bonta made was to tell some not to come. Until & unless City management complies w/the Califonia Public Records Act & discloses the names of the applicants [& names are not generally considered "intimate details" since they are sold on various & sundry mailing lists], we won’t know how honest the answers given in the public comment period really were.
Meyers-Nave is a major municpal manager in California, Its influence cannot be discounted. It may have been involved in the Bell affair. And BenT. Reyes is a principal in that firm.
